IN THIS GUIDE · EB-5 for Guelph/Eramosa investors: gifted funds without a trail, and conditional residence for people who plan to keep living in Canada
Start with the EB-5 eligibility and application overview
A gift is fine; an undocumented gift is not
EB-5 capital must be obtained by lawful means, and the petition must trace the path of funds from source to the new commercial enterprise. Gifted funds can qualify, but the donor's lawful source must be shown as well, which means the father's own bank records, tax filings or sale documents for whatever produced the money, a gift declaration, and the transfer records. A single wire two years ago with nothing behind it is the classic request-for-evidence trigger. Assemble the donor's evidence now, while he is available to sign and while statements are still obtainable, rather than after the petition is filed.
Capital, jobs and the investor's role
The standard qualifying amount is 1,050,000 dollars, reduced to 800,000 dollars for a targeted employment area or an infrastructure project under the 2022 reform legislation; verify the current figures before committing. The investment must create at least ten full-time positions for qualifying US workers, which in a regional-centre project is generally shown through the project's economic model rather than direct hiring. The investor must be engaged in the management of the enterprise or in policy formulation, which a limited-partner role with the rights typical of that structure ordinarily satisfies. Check the regional centre's designation and the project's approved documentation before relying on its job-creation claims.
Conditional residence is residence
An approved petition and immigrant visa lead to two years of conditional permanent residence, after which the couple must file to remove conditions by showing the investment was sustained and the jobs created. Conditional residents are expected to live in the United States. A family that spends most of the year in Guelph/Eramosa and enters the United States only occasionally risks a finding that residence has been abandoned, which ends the status regardless of the investment. If the real plan is to stay in Canada, EB-5 is the wrong instrument, and a different route or a later application timed to an actual move should be considered.
Derivatives and the child's timing
The spouse and unmarried children under twenty-one are included as derivatives and receive conditional residence with the principal. A fourteen-year-old has ample time, but the family's plans for schooling and residence must be consistent with conditional status; a child who remains in Canada through high school while the parents hold green cards raises the same abandonment issue. Each derivative's residence, travel and tax obligations follow from the status they hold, and US tax residency begins with permanent residence, which is a matter for cross-border tax advice before the visa is issued.
