Use citizenship documents when comparing nationality-based US routes

USAvisa field guide · 3 minute readReviewed 7 September 2026
THE SHORT ANSWER

A person living in Guelph may hold Canadian permanent residence and citizenship of another country. Record those facts separately. The PR card is important Canadian documentation, but it does not establish the citizenship required for TN or the relevant treaty nationality for E-2. The key decision is which nationality-based route, if any, the person can actually use, rather than which Canadian document is easiest to show. Hypothetical example: A classical-instrument repairer holds Canadian permanent residence and a Chilean passport, and is invited to join a US restoration workshop. The PR card supports the person’s Canadian residence but does not create TN citizenship. The applicant should begin with the passport, then compare the employer relationship, investment facts and temporary purpose to routes whose requirements the facts can genuinely meet. Record the exact passport fact that supports or defeats each option, and update it before commitments are made. The decision is whether the available nationality, employer relationship or investment structure supports a real route. Canadian residence evidence cannot fill a citizenship requirement.

01

Begin with passports already held

Hypothetical example: a Guelph permanent resident holding a Brazilian passport considers TN while a Canadian citizenship application remains pending. TN requires eligible Canadian or Mexican citizenship. For E-2, examine the relevant treaty nationality and enterprise ownership. Record a pending citizenship application as pending rather than proof that nationality has already changed. Create a nationality inventory using current passports, not assumptions based on birthplace, residence or a pending application. For each person, record the issuing country, expiry date and any evidence of another citizenship. The concrete decision is whether a category has an available treaty nationality threshold. A PR card belongs in the Canadian-residence folder, not as a replacement for a passport analysis.

02

Do not force every opportunity into a nationality route

A qualifying employer transfer may warrant L-1 review based on corporate ties, employment and duties. Investor immigrant routes involve their own evidence and requirements. An unavailable TN route does not automatically establish eligibility for any alternative. When TN is unavailable, avoid treating every opportunity as an investor case. A related-company transfer may turn on the corporate relationship and overseas employment; an investment path may turn on nationality, commitment and business control. Decide which factual foundation exists before paying deposits or restructuring a company around a label. An unavailable route does not prove a different route.

03

Keep the Canadian and US records distinct

Check the applicant’s existing status and obligations in each country through the appropriate advice. For family members, record individual citizenships and intended activities. One person’s passport or approval cannot be treated as the entire household’s procedure. Build a family matrix early where nationalities differ. Note each relative’s passport, Canadian status, relationship, planned activity and timing. The decision may be whether a household uses one principal’s route, staggers travel, or retains a Canadian arrangement while an application proceeds. Shared Canadian residence does not synchronize everyone’s US procedure.
