Keep the TN employer record accurate through a reorganization

USAvisa field guide · 3 minute readReviewed 7 September 2026
THE SHORT ANSWER

A TN document set should tell one accurate story about the professional employment being proposed. When an employer changes names or entities during preparation, explain the chronology rather than discarding useful historical records or silently editing signed documents. The deciding choice is whether the proposed job, employer and credential evidence tell the same treaty-profession story before the applicant uses the applicable entry or petition process. Hypothetical example: An urban-forestry analyst receives an offer from a US environmental firm, but the draft letter alternates between arborist, salesperson and consultant. The applicant should choose the accurate listed profession first, then ask the firm to provide a signed duty description, legal-entity evidence and a clear reporting arrangement. A polished packet cannot solve a role that has not been accurately defined. Complete a final line-by-line check against the real offer before submission. The decision is whether every document identifies the same employer, work, qualification and intended sequence. If any item points elsewhere, obtain an accurate replacement or explanation while the facts can still be clarified.

01

Start with the current offer

Hypothetical example: a Guelph architect receives a revised offer from a successor entity after an employer merger. Identify the legal employer, professional duties, intended duration and compensation. Local residence does not change the listed profession’s requirements; establish actual Canadian or Mexican citizenship and the credentials applicable to that profession. Make a fact sheet before requesting letters. List the prospective employer’s exact legal name, worksite, supervisor, compensation, duration and professional duties, then test every later document against it. The concrete decision is whether a mismatch is a harmless historical label or evidence of a different job. Preserve both versions and explain a real change rather than editing dates silently.

02

Explain the historical name

Obtain reliable evidence distinguishing a name change from a different employing entity. Date the change and reconcile the support letter with the offer. Corporate evidence should clarify the arrangement, not distract from the qualifications and work that TN requires. Match credentials to the chosen professional entry before adding background material. Degree records, licences, evaluations and experience evidence serve different functions, and the relevant item depends on the entry selected. Decide whether the available qualification meets that specific standard. If it does not, a longer résumé or employer enthusiasm is not a substitute.

03

Check the procedure before work

Determine whether the applicant will use a petition, visa or admission procedure and what their current status permits. Canadian and Mexican citizens do not always follow identical steps. A submitted document collection is not permission to start the employment. Choose the procedure only after the substantive record is stable. Confirm citizenship, current status, travel facts and whether a petition approach is needed, then sequence notice, travel and work start accordingly. Do not schedule productive US work merely because the documents have been assembled; eligibility evidence and authorization are separate questions.
