CENTRE WELLINGTON · IMMIGRANT INVESTOR BRIEFING

Compare project obligations with employer-funded Gold Card terms

USAvisa field guide · 3 minute readReviewed 7 September 2026
THE SHORT ANSWER

An EB-5 subscription and a corporate Gold Card offer can both require substantial financial review, but they create different obligations. EB-5 involves qualifying at-risk capital and job creation. Gold Card uses a gift framework within applicable immigrant eligibility rules, with specific corporate and family charges. The decision is not merely which payment is larger; it is whether the household is prepared for an at-risk job-creation investment or for the stated government-gift framework while separately meeting immigrant eligibility. Hypothetical example: A prefabricated-bridge-component entrepreneur can fund an EB-5 expansion that depends on documented jobs, or consider Gold Card after receiving a corporate offer. The family should compare source-of-funds proof, commercial risk, payment permanence, eligibility evidence, and the employer’s private terms before moving money. Neither route turns a sponsor’s promise into an approval. Keep a joint ledger that identifies what each payment accomplishes, what evidence it requires, and whether it can return. The decision should account for commercial risk, family timing and eligibility separately. That comparison prevents a large payment from being mistaken for work authorization or an assured immigration result.

01

Read the operative documents

Hypothetical example: a Guelph shareholder compares an amended regional-centre project with an employer-funded corporate Gold Card proposal. For EB-5, examine the current project, subscription terms, amendments and job evidence. For Gold Card, separate official programme obligations from the employer’s retention or reimbursement agreement. Neither sponsor can guarantee the agency’s decision. For EB-5, inspect the operative enterprise documents, capital deployment, job model, fees, refund terms and source-of-funds trail. The concrete decision is whether the project’s immigration evidence and commercial terms justify an at-risk investment. A presentation deck cannot replace signed documents or explain a missing money trail.

02

Compare the full household costs

EB-5 uses the applicable investment threshold and separate processing expenses rather than another full investment for each derivative. Corporate Gold Card starts with a US$2 million principal gift and a US$15,000 per-person processing fee; eligible joining relatives add US$1 million gifts each. Corporate ongoing and transfer charges are separate events. For Gold Card, separate government-stated payments from employer reimbursement, retention, annual or transfer arrangements. Decide who will pay each amount, under what official instruction, and whether any private repayment clause is acceptable. A payment made by an applicant to the U.S. government is a gift, not a share purchase or conventional visa fee.

03

Ask what a payment accomplishes

An EB-5 investment does not guarantee repayment or approval. A Gold Card gift does not purchase equity or employment permission. Assess admissibility, visa availability and the relevant classification, then coordinate travel and work with the actual immigration step rather than the date money leaves an account. Compare the family consequences on one worksheet: derivative timing, work plans, conditional residence under EB-5, the investment’s possible return, and the finality of a government gift. The decision may be to proceed with one route, defer a commercial commitment, or retain another immigration strategy. Visa availability and admissibility remain separate from either payment event.
