Hypothetical example: a Guelph employee is asked to transfer to a U.S. affiliate to maintain an internal quality-control process. Their training was mostly practical and several other employees have some related knowledge. L-1B preparation should explain the specific knowledge and its special or advanced character within the applicable definition, rather than claiming that the applicant is indispensable simply because the team is busy. L-1B requires the same qualifying-company relationship and the same continuous one-year foreign-employment period within the last three years, but its focus is specialized knowledge. The total L-1B period is capped at five years. A persuasive package identifies knowledge of the company’s product, method, research, equipment or practice, then explains why it is special or advanced in the organization rather than merely valuable experience. Have the technical supervisor identify a recent difficult problem that required the transferee’s unusual internal knowledge. Link that problem to controlled records and the proposed US deliverable. This sharply distinguishes a company-specific capability from standard industry experience and helps determine whether the proposed assignment is ready to be documented. Finally, compare the description with the individual’s actual first assignment. Identify the proprietary material, internal method or advanced company practice the person will use, and who can corroborate it. This enables a sensible decision about readiness: wait for better evidence, narrow the assignment, or proceed with a factual explanation of specialized knowledge.

01

Describe what the employee knows

Identify the process, its application in the organization and the tasks requiring that knowledge. General industry competence and company-specific knowledge can coexist; explain their relationship with concrete examples. A confidential label does not by itself demonstrate specialized knowledge. Start with the information itself: controlled manuals, system architecture, revision history, technical training and examples of unusual problem-solving. General industry ability is not transformed into specialized knowledge by calling it proprietary.

02

Substantiate learning without inventing certificates

Practical training can be documented through project assignments, supervised work, internal records and knowledgeable explanations. Identify how the employee acquired and applied the relevant knowledge. Do not create a training certificate that was never issued merely because a file looks incomplete without one. Then show the employee’s connection to that knowledge. Training records, project assignments, access permissions, authored materials and supervisor statements can establish depth and role. Vague praise is less useful than a concrete account of what the person can do.

03

Compare knowledge carefully

Explain the relevant comparison within the organization or field without declaring that nobody else can perform the work. Specialized knowledge need not be unique throughout the world. The analysis is not a labour-market search for proof that no US worker is available. Examine the US assignment as closely as the foreign history. The role should use the identified knowledge for the related organization, with a clear reporting structure and deliverables. A customer-facing arrangement needs particular clarity about who controls the work.

04

Complete the transfer requirements

Establish a parent, branch, subsidiary or affiliate relationship, both entities’ active business, one continuous year of qualifying employment abroad within the preceding three years, and proposed U.S. duties as well as the knowledge claim. A new-office petition receives an initial one-year approval and needs sufficient premises plus capacity to support the role. If the employee is placed primarily at an unaffiliated client site, the petitioner must retain principal control and supervision and the arrangement cannot be labour-for-hire. L-1B status is subject to a maximum of five years. Preserve an accurate status timeline and compare future assignments with the five-year L-1B limit. A promotion that materially changes the classification question needs assessment before it is treated as a routine internal personnel action.
