No; filing Form I-829 does not itself remove conditions or create a universal repayment date. Assess the applicable sustainment requirements together with the investment’s commercial terms. The project may have no obligation or ability to return funds when the petition is filed.
Track two different calendars
Record the conditional-residence dates and the I-829 filing window, generally the 90 days before the second anniversary of conditional residence. Separately record contractual exit provisions and actual project performance. Avoid promising either repayment or removal of conditions merely because one filing milestone has been reached.
Track commercial milestones and immigration milestones on different lines. The review should record petition filing, any visa or adjustment stage, admission or adjustment, conditional-residence dates, project deployment and job-creation evidence. A petition decision is not itself residence, and later condition removal requires its own timely evidence. Delay occurs when an investor waits for the project to organize records only after conditional residence begins. Hypothetical example: An electric-motor remanufacturing depot forecasts hiring in phases over several years. The investor should preserve updates, payroll-related evidence and explanations as the plan develops, rather than assuming the initial economic report will answer every later question.
Use a written checkpoint for petition milestones, conditional residence and project evidence. Name the original record, the person responsible for obtaining it, and the date by which any contradiction must be resolved. This lets the applicant make a practical decision from verified facts instead of relying on a convenient assumption. If the answer changes the structure or schedule, revise the plan before the next immigration step.
