Can the employer promise that I will start US work as soon as it pays for a Guelph applicant?

THE DIRECT ANSWER

Payment does not itself authorize employment or establish permanent residence. The applicant needs the actual status or authorization permitting the work, following the applicable immigration process. Vetting, category eligibility and visa availability can affect the sequence despite the employer’s preferred start date.

Coordinate staffing with an actual immigration milestone

If a separate temporary work route is being considered, assess its requirements independently. A pending immigrant case can be relevant to temporary-entry questions and should be disclosed accurately. The employer should plan coverage without representing a payment receipt as permission to begin the US assignment.

Do not set a US work start from the date money is sent. The review should map vetting, the underlying immigrant process, visa availability, any separate temporary-work option, travel, and the employer’s staffing need. Official notices and the actual authorization settle when work may begin; a payment confirmation does not. Problems arise when a business treats a gift receipt as permission to relocate an employee. Hypothetical example: A semiconductor-equipment distributor wants its newly recruited executive onsite for a product rollout. The employer should maintain interim coverage and assess a separate lawful work route if needed, instead of promising that the Gold Card process will place her on payroll by launch day.

Use a written checkpoint for work authorization milestones, business staffing and travel sequence. Name the original record, the person responsible for obtaining it, and the date by which any contradiction must be resolved. This lets the applicant make a practical decision from verified facts instead of relying on a convenient assumption. If the answer changes the structure or schedule, revise the plan before the next immigration step.
