Read the general eligibility basics overview
Hypothetical example: an Erin millwright supervisor is a Canadian permanent resident and Indian citizen. Permanent residence in Canada is not Canadian citizenship: he cannot use TN, and E-2 depends on treaty-country nationality. L classification is nationality-neutral, but it remains available only if his employer has a qualifying US entity, he completed the required year abroad, and the proposed duties meet L-1A or L-1B rules. Hypothetical example: an Indian citizen who holds Canadian permanent residence manages procurement for an industrial refrigeration-controls manufacturer with a U.S. affiliate. He must decide whether to pursue a company transfer now or wait for Canadian citizenship. The passports, the affiliate records, and the three-year employment timeline answer different parts of that decision.
Two doors that are closed
The first closed door is TN. Its foundation is citizenship of Canada or Mexico, established by passport or citizenship certificate, and no length of residence, no permanent resident card and no provincial licence changes that. Employers frequently assume otherwise, so it is worth saying plainly at the outset. The second is E-2, which requires the investor to hold the nationality of a country with the relevant treaty with the United States. India is not on that list, and permanent residence in Canada does not supply Canadian nationality for this purpose. A household in this position should stop budgeting for either route and turn to what remains, rather than looking for an exception that does not exist. Record every family member's actual nationality before comparing categories. Canadian PR documentation does not change a passport's nationality for TN or E-2 analysis. The useful outcome of the first review is a short list of routes that are legally available, rather than applications built around residence alone.
The door that stays open
The L categories are indifferent to nationality. What they ask about is the relationship between two companies and the beneficiary's own employment history: one continuous year of qualifying employment with the group in the three years before the petition, a qualifying parent, branch, subsidiary or affiliate relationship, both entities doing business, and duties that are either primarily managerial or executive, for L-1A, or based on specialised knowledge of the company's own processes, for L-1B. A millwright supervisor at an Erin installation contractor with a United States affiliate may fit either, depending on what he actually does. That analysis turns on his duties, not his passport. The L review should begin with the beneficiary's payroll history and the two entities' ownership records. He generally needs a qualifying employment year abroad from the prior 36-month period, while L-1A has a seven-year cap and L-1B a five-year cap. Decide whether the role and calendar fit those limits.
The practical differences to plan for
One procedural difference matters for a non-Canadian. Canadian citizens can present an L petition at a port of entry; a citizen of another country must obtain the visa at a United States consulate, which adds an appointment, a wait and a trip. Plan the calendar around that. On the Canadian side, permanent residence carries a residency obligation measured in days present within a rolling period, and years spent in the United States can put it at risk, with consequences for the family's ability to return. Where citizenship is close, some households complete it first. That is a Canadian question for Canadian advice, but it belongs in the same conversation. Map the consular timeline alongside the Canadian residence calculation before the family changes work or school arrangements. An employer transfer may solve the nationality issue but still require a visa appointment and continuing compliance with Canada's residency rules. The household must decide which status is more urgent to preserve.
