Start with the L-1B eligibility and application overview
Ask whether a joint venture is a qualifying entity
A fifty-fifty joint venture may qualify as a subsidiary when the Canadian parent owns half and has equal control and veto power over the entity. Ask for the joint venture agreement, voting provisions and board composition to confirm those rights rather than treating deadlock as disqualifying. The petitioner and the qualifying foreign organization must also remain actively doing business throughout the transferee's stay. Have the agreement reviewed before characterising the venture in the petition. Reserved matters, appointment rights, and deadlock provisions can show who controls operations. If the documents do not support a qualifying relationship, a detailed explanation of the employee's expertise cannot repair that threshold problem.
Ask what the knowledge is actually knowledge of
Specialised knowledge means knowledge of the company's own product, service, research, equipment, techniques, management or procedures, or an advanced level of expertise in its processes. Years in a discipline do not qualify; familiarity with a proprietary method can. The useful question is what she knows that a competent quality manager hired in the United States would not know on the first day, and the answer here is the company's own protocol, its validation history and its deviation handling. Create a comparison table between the company's protocol and the ordinary methods used in the industry, supported by technical records. The aim is not to claim that nobody else could learn the process; it is to show why this employee's company-specific expertise is material to the receiving operation now.
Ask who else in the group could do the work
Petitions are strengthened by an honest comparison between the beneficiary's company-specific knowledge and knowledge ordinarily found in the organization. Specialized knowledge need not be unique or proprietary, so the existence of three trained colleagues would not by itself defeat the case. If the protocol has one author and the group has never trained a second person on it, say that and show it with training records, the revision history bearing her name and the internal documents she produced. Preserve evidence of who was trained, when, and to what level. A small number of trained colleagues does not automatically defeat a case, but it changes the explanation. An initial review should identify the operational consequence if the manager stays behind and test whether documents actually substantiate it.
Ask how long the assignment can run
L-1B status is limited to five years in total, and time already spent in L status counts. Ask whether she has spent earlier periods in the United States for the group, whether periods spent outside the country can be recaptured, and what the company intends to do at the end. Building a two-year assignment without asking what happens in year six leaves the household planning a life around a status with a fixed ceiling. Count prior L admissions before setting the family calendar. L-1B is generally subject to a five-year maximum period, while L-1A is generally subject to a seven-year maximum period. Documented periods away from the United States may be recaptured when adequately documented, so travel records belong in the early review.
