Read the general business expansion overview
Hypothetical example: an Erin fencing and arena-footing supplier opens its first US warehouse and sends its sales director to lead it. A new-office petition provides one year, not a permanent position. The initial filing must show secured premises and capacity to support a managerial or executive role within that year; the extension must show that it happened. Design the first year around producing that evidence rather than around the sales target alone. Hypothetical example: an industrial refrigeration-controls manufacturer leases a small U.S. service bay and wants to transfer its Canadian operations director to open it. The owners must decide whether they can hire and delegate during the first year, rather than merely sending their strongest technician to win contracts. The lease, cash forecast, and hiring schedule will be compared with the extension evidence. The proposed transferee generally also needs an uninterrupted qualifying employment year abroad during the three years leading to the petition, and the L-1A maximum period is generally seven years.
What the opening file has to contain
Sufficient physical premises secured before filing is a specific requirement, not a preference, so a signed lease with a plan of the space carries more weight than a letter of intent. Alongside it the file needs evidence that the United States entity has been properly formed, that the qualifying relationship with the Erin company exists on the share register, and that the Canadian company can fund the new operation. The business plan should be specific: what will be sold, to whom, at what margin, with what staff hired in which months. Vague projections are read as an absence of planning rather than as optimism. Put the premises, capitalization, and staffing assumptions in one dated plan. The business must determine whether the space is sufficient for the proposed activity and whether its cash can carry the operation until hiring occurs. A signed lease without a feasible operating plan proves only that rent is due.
The trap in sending your best salesperson
A sales director is often the obvious person to open a market and the most difficult person to sustain in a managerial classification. If the whole first year is spent selling, the extension will be assessed against a beneficiary who is a producer rather than a manager, however senior the title. The way through is to plan the hiring so that by the twelve-month mark there are people to direct, and to define the role from the start as building and running the operation rather than personally carrying the sales quota. Write that into the plan, and then follow it, because the extension file compares the two. Assign the transferee's production tasks to named employees or contractors from the start, with dates and a budget. The question is whether sales work is temporary market development or the person's continuing core job. An extension assesses the real role, so a title cannot compensate for a year of hands-on output.
What the extension will actually be judged on
At the end of the year the company should be able to show what the plan promised: employees on payroll, an organisation chart that is no longer aspirational, contracts, revenue, and premises in use. It should also be able to explain any variance honestly, since markets move and a reasoned explanation is more persuasive than a restated projection. Keep the evidence contemporaneously: payroll registers, signed contracts, bank statements, photographs of the warehouse in operation. Reconstructing a year at month eleven is expensive and produces a thinner file than keeping the records as they were generated. Create a monthly evidence folder from the first week: payroll, customer agreements, invoices, bank activity, organisation charts, and proof that the premises are used. The owners must decide who maintains it and who can explain a variance. A record created as events occur is more reliable than a retrospective reconstruction.
