PROGRAMME BRIEFING · ERINErin

A new route.Know the details.

Hypothetical example: a retired Erin developer who spent thirty years building equestrian facilities wants to spend most of the year in the United States and still take calls from the Ontario company his daughter now runs. Somebody told him the Gold Card would solve everything. It is worth being precise about what the current official framework actually offers, because most of the questions he is really asking are about work authorisation, tax residence and how long he can stay, and only some of those are answered by the programme at all. The immediate decision is whether the applicant is prepared to make a non-investment payment remitted straight to the U.S. government under the current official process. It should be treated as a programme-specific eligibility question, not in lieu of due diligence on work, residence, tax, or licensing. No money should move through an adviser or an unofficial payment channel.

Start with the GOLD CARD eligibility and application overview

01

Ask what the programme is described as, officially

The current framework is set out on the official programme page and in the executive action that created it, and it is built around a gift to the U.S. government together with a processing fee. That is a different thing from a conventional visa category with statutory eligibility criteria, and it should not be described as one. Read the official material directly rather than relying on a summary, and re-read it before any money moves, because a new programme's terms can change. Confirm the programme terms at the point of payment and retain the official instructions with the receipt. For an individual case, the applicant must remit payment straight to the U.S. government; no payment is a remittance to a consultant or a business seller. Current official material controls if a summary says something different.

02

Ask what it does not do

It is not a business licence and it is not a substitute for professional or trade licensing in any state. Under the current official framework, a successful applicant receives lawful permanent resident status as an EB-1 or EB-2 visa holder, which authorizes employment generally. Corporate, professional-licensing and tax questions remain separate, and payment alone does not confer status. Re-verify the framework before money moves. List each activity the person plans to undertake after arrival: advisory calls, running a company, signing contracts, practising a regulated occupation, or merely holding investments. Then test those activities under the relevant immigration, corporate, professional, and tax rules. A payment cannot resolve obligations that belong to another legal system.

03

Ask how it differs from an investment

The payment contemplated by the framework is a gift, not capital placed in a business. Nothing is expected to be returned, no jobs test attaches to it, and there is no enterprise to manage. That is the opposite of the EB-5 structure, where a qualifying amount is placed at risk in a new commercial enterprise and can be lost or, in principle, returned. Conflating the two produces bad decisions in both directions. Write the comparison on two columns before choosing. EB-5 calls for capital exposed to an enterprise's risk, job creation, and later removal of conditions after conditional residence. A Gold Card payment never becomes business capital and creates neither an investment return nor an enterprise-management requirement.

04

Ask who else in the household is covered and at what cost

Under the current official terms, a spouse and unmarried children under twenty-one may be included in the initial application, with a separate processing fee and gift for each person. A married child or a child aged twenty-one or older is not included under those family terms. Confirm the current terms for every named person before paying. Obtain the official answer on eligibility and cost for each proposed family member before an application is submitted. Do not assume that a spouse, an adult child, or an unmarried child is automatically included by the principal's payment. The decision record should identify each person, the applicable charge, and the source that confirms treatment.
