ERIN · EB-5 FIELD GUIDE

What costs beyond the investment should an Erin family expect?

THE DIRECT ANSWER

Regional centre administrative fees, legal fees for the petition and the source of funds work, translation and document retrieval, government filing charges taken from the current fee schedule, and later filings to remove conditions. Some of these are payable whether or not the petition succeeds.

The investment is the recoverable part; the rest is not

It is worth separating the money that becomes an asset from the money that is simply spent. The qualifying capital is invested in the enterprise and is at risk, which means it can be lost but is not a fee. Everything else is expenditure.

A regional centre project ordinarily charges an administrative fee on top of the subscription, and that is not returned if the project underperforms. Legal fees for an EB-5 petition are substantial because the source of funds analysis is document-intensive, and where the funds come from a redemption and a matrimonial settlement the work grows. Document retrieval, certified translations, valuations and accountant time all add up.

Government charges apply at several stages, including the initial petition, the immigrant visa or adjustment stage, and later the petition to remove conditions, and current amounts should be taken from the published fee schedule. Budget for the conditional stage as well as the first filing, because families frequently plan only as far as the first approval.
