Canadian PR, Chinese citizenship: which US routes remain for a Puslinch systems specialist

THE SHORT ANSWER

Hypothetical example: a Puslinch systems specialist has Canadian permanent residence but mainland-Chinese citizenship. TN is reserved for Canadian or Mexican citizens, and E-2 requires treaty-country nationality, which this passport does not provide. L classification does not turn on nationality, so a qualifying corporate relationship, foreign-employment year and company-specific role may provide the route instead.

01

Tell the employer early, in one sentence

Recruiters and hiring managers rarely distinguish between residence status and nationality, so a candidate in this position should raise it himself and in plain terms: he is settled in Canada but travels on a Chinese passport, which closes the professional trade-agreement route and the treaty investor route and leaves intracompany transfer. Saying that in the first conversation avoids an offer built on the wrong assumption, and it changes what the employer needs to do, because a transfer requires the company to file rather than the candidate to present himself. Employers who hear it late sometimes withdraw simply because the timeline no longer works.

02

What the transfer route asks instead

Its questions are about the company and the job history. Has he spent twelve unbroken months working for this group somewhere outside the United States during the last three years, evidenced by payroll rather than by recollection. Are the sending and receiving companies genuinely related as parent, branch, subsidiary or affiliate, and is each of them actually trading. And does his work rest on something proprietary to the employer, such as an implementation methodology or a deployment toolkit he helped build, rather than on being a capable practitioner in a widely practised field. Where those three hold, the passport becomes irrelevant to the analysis.

03

Two calendars to add to the plan

The first is consular. Because he is not a Canadian citizen he cannot simply present an approved petition on arrival; he books an interview, waits for it and travels to it, and that sequence should be priced into any start date the employer proposes. The second is Canadian and easy to forget while everyone concentrates on the American side. Permanent residence obliges the holder to accumulate a minimum number of days in Canada over a rolling window, and a multi-year posting abroad eats into that, which can complicate a later return or an application for citizenship. A Canadian immigration lawyer should look at that before, not after, the family commits.
