When the engagement changes: reissuing a Puslinch consultant's TN documents

THE SHORT ANSWER

Hypothetical example: a Puslinch management consultant whose engagement changes should identify which documents must be reissued. The degree or five years of documented consulting experience stays as it is. The consulting agreement and the engaging entity's support letter must be rewritten to describe the new scope, period and contracting entity, and a materially changed case must be presented before the new work begins.

01

The agreement in its new form

A variation email is a commercial instrument and a poor evidentiary one. Where the scope has genuinely changed, produce a signed agreement or statement of work that stands on its own: what will be delivered, over what period, for what fee, and to whom. Avoid language that reads as an open-ended appointment, since the classification contemplates consulting for a defined purpose rather than occupation of a permanent position. Where the client is part of a group, identify the contracting entity precisely, because groups reassign work between subsidiaries without regarding it as significant. A different contracting entity is a different case.

02

The support letter from the engaging entity

The letter should come from the entity that is actually engaging the consultant, on its letterhead, describing the work in its own words. It should confirm the contractual relationship, the period, the deliverables and the fee arrangement, and it should be consistent with the agreement rather than a paraphrase of it. Where the change involves any element of line responsibility, that has to be described honestly, because a letter that conceals an operating role produces a worse outcome than one that discloses it and is assessed properly. Request a draft and review it before it is signed, since a signed letter is much harder to correct.

03

What does not change and what to do next

Credential evidence is static. A degree and transcript, or the letters and engagement records supporting the five-year experience alternative, are produced again in the same form. Proof of Canadian citizenship likewise. What changes is the assessment: whether the new scope is a variation that an extension can cover, or a materially different arrangement requiring a fresh application on the new facts. Make that assessment before the new duties start. Where the change involves stepping into an operating role at the client, treat it as a new question altogether rather than as a larger version of the old one.

A CONVERSATION IS A GOOD PLACE TO START.
