FOR SPECIALIST TEAMS · PUSLINCHPuslinch

Your expertise.Across borders.

Hypothetical example: a Puslinch company that builds control systems for crushing and screening plants transfers its automation specialist to a United States affiliate. He wrote the ladder logic library and the fault-diagnosis routines the company installs on every plant. Fourteen months in, the affiliate wants to promote him to engineering manager. That promotion is the interesting part, because L-1B and L-1A are different classifications with different tests and different maximum periods, and moving between them is a new petition rather than a change of title.

Start with the L-1B eligibility and application overview

01

Knowledge of the company, not of the trade

Specialised knowledge is special knowledge of the employer's own product, service, research, equipment, techniques, management or other interests and their application in international markets, or advanced knowledge of the organisation's processes and procedures; general industrial-automation skill is not enough. The petition must also prove one continuous year of qualifying employment abroad within the three years before filing, a parent, branch, subsidiary or affiliate relationship, and that the qualifying organization will keep doing business in the United States and at least one other country throughout the stay.

02

What a promotion actually requires

L-1B and L-1A are separate classifications. A person cannot drift from one to the other because the business card changed. Moving to a managerial role requires a new petition establishing that the L-1A test is met on the new facts, including duties that are primarily managerial or executive. It is not automatic and it is not a formality, and the receiving company should be able to describe the subordinate structure before it makes the offer rather than afterwards.

03

The ceilings and how time is counted

L-1B is limited to five years and L-1A to seven, and time already spent in either counts toward the applicable maximum. Where a person moves from L-1B to L-1A, the earlier L-1B time is generally counted, so the promotion does not reset anything. Time spent physically outside the United States can sometimes be recaptured, but only if it is documented as it occurs. Households that expect a long stay need to plan for what follows the ceiling well before reaching it.

04

Where the work is performed

Placement at a customer's site is a recognised difficulty for this classification. Work performed principally at a third party's location can only be supported where the petitioner continues to control the work and the arrangement is not, in substance, the supply of labour to another business. For a controls specialist commissioning plants on customer sites, that means documenting supervision, the retention of technical direction, and the fact that the customer is buying a system rather than a worker.

05

Specialized knowledge means the company's, not the industry's

Explain the employee’s understanding of the actual configuration and operating methods, distinguishing ordinary vendor familiarity from the claimed company knowledge. Broad claims about talent, loyalty, or ordinary industry skill do not establish specialized knowledge. Begin with concrete examples: internal procedures the employee has applied, training records, projects that required the knowledge, and an explanation of why the US assignment calls for it. An initial L-1B review should turn claimed expertise into specific, verifiable knowledge: the product feature, internal process, training source, users of the knowledge and why the US assignment needs it. Avoid claiming the knowledge is unique if a dozen colleagues have it; describe the actual distribution honestly. Do not assert that the knowledge must always be unique or proprietary; equally, a good performance review or experience with widely used equipment does not establish the requirement by itself.
