Read the general business expansion overview
Hypothetical example: a Puslinch equipment dealer opens a new U.S. parts-and-service branch and transfers a specialized-knowledge employee. The one-year petition must show secured premises, a qualifying corporate relationship, an active foreign business, financial ability to pay and commence operations, the beneficiary's qualifying year abroad, and the specialized role. Extension evidence must show what the first year actually produced.
What the first filing must establish
The first filing must establish the parent, branch, subsidiary or affiliate relationship, that the foreign company is actively doing business, and that the beneficiary completed one continuous year of qualifying employment abroad within the preceding three years. The U.S. entity must be formed, sufficient premises secured, and the foreign company must show financial ability to pay the beneficiary and commence business. Finally, the beneficiary's specialized knowledge must be tied to the company's own products, processes or procedures rather than to general industry experience.
The year the petition actually buys
One year is not a soft start; it is the whole authorised period, and the extension is a fresh assessment. The year should therefore be designed to produce evidence. Hire when the plan said hiring would happen and keep the payroll registers. Sign the service contracts and keep them. Order and take delivery of the parts inventory and keep the invoices. Use the premises and be able to show it. A company that spends the year working and intends to assemble the file in month eleven finds that the most persuasive material, contemporaneous records of a business coming into existence, was never captured.
What changes at the extension
Two shifts occur. First, the standard moves from plausibility to performance: the question is no longer whether the plan is credible but whether the operation is real, trading and employing people. Second, the specialised knowledge description has to still be true. If the beneficiary spent the year running counter sales and general service work, the role has drifted toward ordinary skilled employment and the extension is weaker for it, however busy he was. Where the intention is eventually to move him into a managerial role, remember that is a separate classification with its own test and its own petition, and that prior L-1B time counts toward the maximum.
