Read the general immigrant investor briefing overview
Hypothetical example: a Puslinch haulage owner with a stalled EB-5 petition compares that investment with an irreversible Gold Card gift. EB-5 uses at-risk capital in a job-creating enterprise and leads to two-year conditional residence, with Form I-829 filed in the 90 days before the second anniversary. Under the current official framework, Gold Card uses a processing fee, vetting and gift for an EB-1 or EB-2 lawful-permanent-residence process. Frustration with the pending case is not a reason to withdraw before reviewing both files and re-verifying Gold Card terms.
What each one does with the money
Under the investment programme, a qualifying amount is placed at risk in a new commercial enterprise, must be sustained for the period the law requires, must produce at least ten full-time positions for qualifying United States workers, and must be traceable to a lawful source documented from origin. It can be lost, and in principle it can be returned once the requirements are met. The Gold Card framework contemplates a gift to the U.S. government with a processing fee: no enterprise, no job model, no return. Both are large sums. Only one of them is capital, and that difference should drive the decision more than any comparison of headline figures.
What each one does when things change
This is where his experience is relevant. A project that materially changes its business plan while a petition is pending can force a refiling on the new facts, with the cost and delay that implies, and after approval the question becomes whether the requirements will still be met. That is genuinely frustrating and it is also a known feature of the structure, addressed in the offering documents he should reread. The other framework does not change under him in the same way, because there is no project. It can, however, be adjusted by the authority that created it, and a payment already made cannot be recalled if it is. Neither route is immune to change; they are exposed to different sources of it.
Before withdrawing anything
A pending EB-5 petition carries spent fees, completed professional work and a priority date that may have value; none transfers to Gold Card. Review the filing before withdrawing it. Under current Gold Card terms, a spouse and unmarried children under twenty-one may be included in the initial application, but each requires a separate $15,000 processing fee and $1 million gift. A successful applicant receives lawful permanent residence through EB-1 or EB-2, subject to eligibility, admissibility and visa availability. Confirm every family member, take residence and tax advice, and re-verify official terms before payment.
