PUSLINCH · L-1A FIELD GUIDE

Does a Puslinch terminal manager's role count as managerial for L-1A?

THE DIRECT ANSWER

It can, but not because he supervises a large crew. The category looks for management of an organisation, department, subdivision or function, supervision of other supervisors or professionals, and authority over personnel decisions. Supervising employees who are not professionals does not, on its own, make somebody a manager for this purpose.

Structure beneath the role, not headcount

The statutory framing catches many operations people out. A person who directs thirty dock workers and drivers feels unmistakably managerial in ordinary language, yet the definition specifically excludes first-line supervision of employees who are not professionals unless the supervised staff are themselves supervisory. The two ways through are to show supervision of subordinate supervisors and professional staff, or to show management of an essential function of the organisation with the discretion that goes with it.

For a cross-dock terminal, that usually means demonstrating shift supervisors, a dispatch lead, a safety or compliance role and an administrative function, all reporting into the position, together with authority over hiring, discipline, budgets and service commitments. The evidence is an organisation chart with named positions and salaries, job descriptions for the subordinates, and a duty breakdown that honestly allocates his week. Where the honest breakdown shows him covering dispatch himself most days, the category is the wrong one and it is better to know early.
